News [Pakistan] State must ensure every woman receives her rightful share in inheritance
Quote:The Supreme Court has ruled that the state must ensure every Pakistani woman gets her share in inheritance and called for a mechanism to assist them in securing this “divinely bestowed” right.
Quote:The state had a constitutional duty to ensure that “every woman is informed of, and enabled to claim her rightful share in inheritance without delay, fear or dependence on lengthy litigation”, the judgment read.
It added that the state must establish a “proactive and accessible mechanism through which women can be identified, reached out to,” and assisted in securing their lawful entitlements.
“Furthermore, those who, through coercion, deceit, or undue influence, deprive women of this divinely bestowed right must be held accountable under the law and made answerable,” Justice Minallah stressed.

Quote:It termed such customs “remnants of ignorance which the message of Islam came to abolish”, and noted that the state bore a “sacred constitutional duty to uproot such practices”.Part of the reason Islam was so abhorrent a threat to the feudal west back in the day was because they had such extensive and equitable property rights. Very heartened to see not even all those nimble probing CIA fingers can quash that tenet in Pakistan.
“A society that turns a blind eye to deprivation of inheritance rights to its women defies the spirit of Constitution and express Command of Almighty Allah,” the ruling stated.
Awesome that they got such a resounding official ruling.
This part was such a slam dunk to read:

Undoubtedly good news but two issues remain imo.

Again, I do agree with Chernobog that Islam had a much better system that feudal times, but we're in modern times now.
- He says Godly sacred rights, which means the system where women get half of what men get. The Islamic inheritance system is complicated, in a way that I definitely can not explain but to summarise more or less, let's take the case where there's a wife, and two children, one man and woman. The son will get 50%, the wife 25%, and the daughter 25%. This is veryyyy simplified, because it would take an eternity to explain the whole thing, and it's even worse if you have only daughters, but more or less I'd like it if it were equal at 33%, but maybe a pipe dream.
Still, overall, it's good news, but a long way to go.
- This is a case from 2015 resolved in 2025, which means the justice system is rather slow. My mother herself is waiting since 2007, but she never went to court, because how can you take your own family to court? (Her words, not mine, I've always said to drag them to court)
This perspective was much appreciated.
